Payment I always do payment through paypal. I always ask for 50% of the total cost as a deposit before I start any work. All my prices are in USD.
Terms Of Service
General
• Paypal is the only form of payment available. 50% of the total cost will be paid before any work is completed.
• The commissioner is not allowed to trace, edit, repost, sell, or render the artwork in any way not discussed and agreed upon by the artist and commissioner. The commission is also not allowed to remove any watermarks or signatures.
• The commissioner may share the artwork on social media with credit to the artist, use as a gift, use as a profile picture on social media, print it out for personal use, and show it to peers.
• My artwork may never be used as an NFT or involved in any sort of blockchain-related technology.
• My artwork may never be used for submitted to any AI art generator.
• The artwork will be provided to you digitally and is not a physical product. If you want it for printing size, let me know ahead of time and I will ensure it will print properly if you choose to do so. Often delivered as a high resolution PNG, Gif (If animated), MP4, etc. Specific file types can be requested based on what it is you order.
• I, Grimhilde, maintain the rights to the artwork created for commissions. I do not maintain the right to any characters owned by the commissioner or any established IPs.Commercial Commissions
• Commercial usage means the commissioner is generating any kind of profit from the use of the artwork. The commissioner will buy the rights to use the artwork for this purpose. For an individual, there will be a 10% fee from the overall cost for digital-only uses. For distribution purposes, like making prints, keychains, etc, there will be a 25% fee. For agencies it would be 25% and then 50%.
• The commissioner must include what the artwork will be used for and any specifications for the project. (Like printing measurements, type of project, etc)
• The commissioner cannot claim ownership of the artwork itself, even with full commercial rights. Meaning you will not claim that you illustrated it yourself. The artist also maintains the right to use the work in portfolios and, if it is not a private commission as agreed beforehand, on social media.
• Commercial usage includes: streaming assets, game assets, promotional work, designs for stickers, charms, prints, or any kind of merchandise.
• Even with commercial rights, the commissioner does not have the right to us the artwork for any blockchain-related currency such as NFTs. They also may not submit the artwork into any sort of AI-generator. This also includes the intention to use the artwork for a base for future AI or NFT spaces.Refunds
• Refunds are only available during the process of the commission. Once completed refunds are no longer an option.
• A refund must be requested before linework is completed. For any cancellation after this point a 40% cancellation fee will be enacted.
• In the case of financial crisis, (job loss, medical emergency, unexpected expenses)full refunds will be considered but the artwork is forfeit and not to be used in any way by the commissioner. If you want to reopen the commission after your finances have been settled, you can contact me at that time.
• If chargeback is filed after the commission is completed and send to the commissioner, the commissioners rights to everything that the artist created will be retracted. A warning to other artists will also be made.
• If I am unable to complete your commission for any reason you will be given a full refund.
• If necessary, Grimhilde, the artist has every right to file a complaint or report to receive compensation for my work.Copyright Infringement
• The following are considered violations of the agreement:
• Unauthorized reproduction, distribution, tracing, editing, sale, or commercial use of the copyrighted artwork is strictly prohibited without my prior consent. This includes generating any profit from the commission in any way without first obtaining my approval.
• Claiming credit for creating the artwork, or misrepresenting yourself as the artist, is strictly prohibited.
• Reposting the artwork without providing proper credit is not allowed.
• Removing watermarks or signatures from any work-in-progress images or completed illustrations is strictly prohibited.
• Any alteration or modification of the artwork without my consent is not allowed.
• The completed commission may only be used for its intended purpose as agreed upon by the artist and commissioner. Any use outside of the initial agreement, including commercial use, is not permitted.
• Using any of my illustrations in any blockchain-related technology, including NFTs, cryptocurrency, or AI-generation, or any future inventions within those spaces, is strictly prohibited.
• In the event that the commissioner violates any of these terms, all rights to the commission will be retracted, and the commissioner will be blacklisted. A warning will also be issued to potential vendors.
